Apple Inc. and AppleCare Services Co. charge customers AppleCare+ subscription fees after the devices associated with the subscription have already been traded in or returned, in violation of the AppleCare+ agreements, a proposed consumer class action alleged.

Both AppleCare+ subscriptions and trade-ins are tracked by device serial numbers, so Apple “knows when a device covered by an AppleCare+ contract has been traded in or returned,” according to the complaint filed Monday in the US District Court for the Northern District of California. The AppleCare+ program gives device owners coverage that extends beyond the device’s standard warranty.
